FREEWARE LICENSE AGREEMENT
for eXtra Buttons
IMPORTANT READ CAREFULLY
This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Nikolaj Parshutin and Alex Skrypnyk about eXtra Buttons, which includes computer software and "online" or electronic documentation ("SOFTWARE").
By downloading, installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE.
Copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect the SOFTWARE. The SOFTWARE is licensed, not sold.
1. GRANT OF LICENSE.
This EULA grants you the following rights for SOFTWARE. Except as otherwise provided herein, you, as an individual or an entity, may install and use copies of the SOFTWARE on an unlimited number of computers, including workstations, terminals or other digital electronic devices ("COMPUTERS").
The SOFTWARE is in "use" on a COMPUTER when it is loaded into temporary memory (i.e. RAM) or installed into permanent memory (e.g., hard disk, CD-ROM, or other storage device) of that COMPUTER.
2. DESCRIPTION OF RIGHTS AND LIMITATIONS.
a. Your rights as a user
You may copy the SOFTWARE, provided that such copies contain all the original SOFTWARE contents and proprietary notices. You may collect a reimbursement for the costs of producing the copy, but you cannot charge a licensing fee for the SOFTWARE;
You may place the SOFTWARE on the Internet or any other public access network as long as you also acknowledge SOFTWARE and place a link back to SOWTWARE's website - www.xtrabuttons.com .
You may permit other individuals to use the SOFTWARE under the terms listed above.
b. Limitations on Reverse Engineering, Decompilation, and Disassembly.
You may not reverse engineer, decompile, disassemble, emulate, and extract images from all SOFTWARE or one of its parts (i.e. libraries). You may not include the SOFTWARE in any other software collection or other product. You may not remove any proprietary notices on the SOFTWARE.
You may not rent, lease, or lend the SOFTWARE. You may not sell licenses for the SOFTWARE.
d. Software Transfer.
You may permanently transfer of all of your rights under this EULA. You may retain copies of the SOFTWARE (including all component parts, any upgrades, this EULA). If the SOFTWARE is an upgrade, any transfer must include all prior versions of the SOFTWARE.
Without prejudice to any other rights, Nikolaj Parshutin and Alex Skrypnyk may terminate this EULA without notice you in case of fail to comply with the terms and conditions of this EULA or in case of taking actions to illegally remove freeware limitations in any way and for any purpose. In such events, you must destroy all copies of the SOFTWARE and all of its parts.
NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE THE PROGRAM AT YOUR OWN RISK. NIKOLAJ PARSHUTIN AND ALEX SKRYPNYK DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NOBODY WILL BE LIABLE FOR DATA LOSS, DAMAGES, AND LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE.
